FLOYD COUNTY, TX  – A burn ban is now in effect for all unincorporated areas of Floyd County following the issuance of an emergency order by Floyd County Judge Marty Lucke due to the increased threat of wildfires.

The emergency order, identified as Order Number 2026EBB-001, was signed on January 7, 2026, and officially will take effect at 5:00 p.m. Wednesday, January 7, 2026.

The order was issued under the authority of Chapter 418 of the Texas Government Code, also known as the Texas Disaster Act of 1975, citing dry conditions and the imminent risk of wildfire.

Under the burn ban, all outdoor burning of combustible material is prohibited unless the fire is contained within an enclosure designed to fully contain flames and sparks. Ordering or allowing others to conduct outdoor burning that violates the order is also prohibited.

According to the order, when suspected outdoor burning is reported, the fire department assigned to the area will respond immediately to contain or extinguish the fire.

Second or flagrant violations of the burn ban may result in prosecution in accordance with Texas misdemeanor statutes. The order may be enforced by any duly commissioned peace officer, and violations will be handled through the Justice of the Peace Court in Floyd County.

The burn ban will remain in effect for up to seven days unless extended by the Floyd County Commissioners Court.
